Terms of Service

1. Parties

These Terms of Service ("Terms") constitute a binding agreement between you ("Client") and MAIA MANAGEMENT GROUP S.A.S. (trading as Maia Realty), a simplified stock company incorporated under Colombian law.

2. Services

Maia Realty provides buyer's agent services in Colombia including property search, independent valuations, legal and conveyancing support (via qualified in-house counsel), tax and accounting services, furniture and fit-out, and rental management. The specific services, scope, fees, and deliverables for each engagement are set out in a separate Service Agreement signed by both parties.

3. Buyer's Agency Relationship

Maia Realty acts exclusively as a buyer's agent. We do not represent sellers and we do not act as a dual agent. Our fiduciary duty is solely to the Client (buyer). Any seller's commission received by Maia Realty will be credited directly against the Client's fees as set out in the Service Agreement.

4. Fees and Payment

Our standard phased fees are: Search Brief (USD $300), Active Search (USD $1,500), and Negotiate & Close (USD $1,500). Post-purchase services are quoted separately. All fees are in United States Dollars unless otherwise agreed. Payment terms are specified in the individual Service Agreement. All prices exclude Colombian VAT (IVA) where applicable.

5. Limitation of Liability

Maia Realty provides professional property search and advisory services. We are not a licensed financial advisor, and nothing we provide constitutes financial, investment, or legal advice. While we engage qualified legal and accounting professionals, the Client remains responsible for their own investment decisions. Maia Realty's total liability for any claim arising from these Terms shall not exceed the total fees paid by the Client for the specific service giving rise to the claim.

6. Confidentiality

Both parties agree to keep confidential all non-public information exchanged during the engagement, including but not limited to the Client's financial position, target properties, and negotiation strategy.

7. Intellectual Property

All content on maia-realty.com, including text, images, and structural elements, is the property of MAIA MANAGEMENT GROUP S.A.S. and may not be reproduced without written permission.

8. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Republic of Colombia. Any disputes shall be resolved first through good-faith negotiation, and failing that, through arbitration administered by the Centro de Arbitraje y Conciliación of the Cámara de Comercio de Santa Marta in accordance with Colombian law.

9. Changes to These Terms

We reserve the right to update these Terms at any time. Material changes will be communicated via the website. Continued use of our services after changes constitutes acceptance.
